The Potential Implications of Pavel Durov’s Arrest for Generative AI Founders

This week started with big news in tech: Pavel Durov, the founder of the popular messaging app Telegram, was arrested upon his arrival in France from Azerbaijan. The arrest sparked a huge reaction across the global social media landscape, dividing opinions into two primary camps that I would like to highlight:
Freedom of Speech Camp: Prominent tech figures, including Elon Musk, are vocal in this group, asserting that Durov's arrest is part of a calculated effort by the French government to suppress free speech. While Telegram does not feature end-to-end encryption by default, like Signal or WhatsApp, supporters in this camp still emphasise its encryption capabilities as a key reason for government scrutiny. However, privacy advocates and cryptographers have highlighted that most Telegram conversations are not encrypted and are stored openly on servers. They argue that the encryption feature being non-intuitive and not default, forces most users of the app to stick with the basic settings.
Geopolitical Camp: This group points out that Telegram is widely used by Russian military and intelligence agencies (FSB & GRU) for covert operations, not just abroad in regions such as the UK, US, EU, and Africa, but also within Russia for monitoring Putin’s political opponents and human rights activists. In particular, they note the app’s role in facilitating communications for the Russian military, specifically for the Russian government’s ‘Special Military Operation’ in Ukraine, aiding in the coordination of attacks on civilian infrastructure.
Moreover, some in the camp argue that Telegram has been used as a tool of digital soft power by the Russian government. They suggest that the French government's concerns originate from Telegram’s role in disseminating misinformation that may undermine French interests, particularly in Africa, where the Wagner Group has been active in former French colonies such as Mali. However, it is important to note that this perspective so far lacks hard evidence of any significant connections between Telegram’s leadership, including Pavel Durov, and the Russian intelligence and security apparatus. Likewise, French President Emmanuel Macron was quick to comment on social media that the charges against Telegram are not politically motivated. Indeed, the French prosecutors also issued this statement highlighting the basis for the charges against Durov.
Regardless of which side you lean towards, an interesting question arises: Could this case serve as a cautionary tale for founders in the rapidly evolving field of generative AI? For the legal experts, I would particularly like to have your take on the following two points:
Legal Responsibilities of Generative AI Platform Operators: Charges against Durov are related to the enabling of illegal transactions through Telegram, including; drug trafficking and dissemination of illegal content. Could the founders and leadership of generative AI companies face similar charges if their platforms inadvertently facilitate unlawful activities, such as; scams, the spread of misinformation, or the creation of harmful content, due to insufficient safeguards?
Cybersecurity and Misuse of Technology: Durov was also charged with offering tools designed to damage automated data processing systems. Could the founders and leadership of generative AI companies be held liable if their AI tools, especially those capable of crafting malware or exploiting software vulnerabilities, are misused?
